Se confirmó el Auto del 13 de enero de 2004 proferido por el Magistrado Manuel José Cepeda Espinosa, que rechazó la demanda de inconstitucionalidad presentada por el ciudadano de la referencia, contra las expresiones “excepto en los procesos ejecutivos” y “no obstante, el superior al revisar el fallo consultado podrá modificarlo sin límite alguno”, contenidas en el Art. 39 de la Ley 794 de 2003, por el cual se modificó el Art. 386 del Código de Procedimiento Civil.
Lo anterior, porque existe cosa juzgada constitucional absoluta en relación con la exequibilidad de la norma demandada.
